EPA Issues Existing Stocks Order for Dicamba Products
Feb 27, 2024
We want to assure customers that have contracted gallons that we have an adequate supply of dicamba products to fulfill contracted gallons this spring. If you are in need of additional supply, work with your local Agtegra Agronomist as soon as possible to ensure available product inventory.
On February 6, 2024, a ruling by the U.S. District Court of Arizona vacated the 2020 registrations for OTT dicamba products XtendiMax, Engenia, and Tavium. On February 14, the EPA issued an order with the requirements for XtendiMax, Engenia, and Tavium. The official statement is as follows:
On February 14, 2024, EPA issued an Existing Stocks Order for Dicamba Products Previously Registered for Over-the-Top Use on Dicamba-Tolerant Cotton and Soybean. This Order addresses use of the formerly-registered dicamba products and authorizes limited sale and distribution of dicamba products that are already in the possession of growers or in the channels of trade and outside the control of the pesticide companies.
Agtegra Cooperative is a seller, distributor and user (commercial applicator) of these products, which means that we can sell, distribute, and apply product that we currently have on hand in inventory AND product sourced from our distributors in compliance with the dates set forth in EPA’s order. Bayer and other manufacturers CANNOT ship any new orders or fulfill orders that are not delivered.
1. Agtegra Cooperative is legally required to comply with the EPA’s order and we will adhere to all EPA requirements.
2. The order sets the end date for all XtendiMax, Engenia, and Tavium sales and distributions of existing stocks for use in SD on May 21, 2024 and in ND on May 31, 2024.
3. The order sets the end date for use (commercial application) of existing stocks of XtendiMax, Engenia, and Tavium in SD on June 20, 2024 and in ND on June 30, 2024.
At this time, Agtegra will be following manufacturer guidelines of not allowing product returns.
Thank you for trusting Agtegra with your agronomy inputs!
